Martha (Patty) JONES and John POWERS were married before 1807 in Virginia. John POWERS19 (son of Major POWERS and Mary (Polly Pettijohn) PETTYJOHN) was born on 25 Apr 1786 in Harrison, Virginia/West Virginia. He died on 4 Apr 1841 in Henry, Indiana.18

LAST WILL AND TESTAMENT OF JOHN POWERS

State of Indiana, Henry County

In the name of God Amen, I, John Powers of Henry County, Indiana, being weak in body but of sound mind and perfect memory, blessed be Almighty God for the same, do make and publish this my Last Will and Testament in manner and form following (that is to say)

I give and bequeath to my eldest son Stanton Powers Eighty acres of land it being the West half of the S West qtr. of sect. 25 Township 19 North of Range ten and

I also give my son Cyrus H. Powers thirty five acres off the North end of the West half of the South E. qtr. Sec 25 T19 north of R10.

I give and bequeath to my son-in-law Edward Benbow forty five off the South End of the West half of the S.E. qtr. Sec 25 T19 North of Range ten all the above named land as described and bequeathed my two sons and my son-in-law as above named to have at the end of my life and my Wife Patty Power's life.

As to my goods and chattels after my decease is to be sold and divided equally between them, that is, all my children after the payment of my debts, and if the above named goods and chattels is insufficient to pay my debts then my heirs is to pay equally out of the land One Hundred and Fifty dollars of which debt is to pay Edward Benbow for the Forty five acres of land above willed he having sold the same to my son-in-law Robert Benbow that now resides on it and the proper owner when the purchase money is paid.

I also hereby appoint Stanton Powers and Cyurus H. Powers the sole Executors of this my Last Will and Testament hereby revoking all former Wills by me made.

In witness whereof I have hereunto set my hand and seal this 14th day of April in the year of our Lord One Thousand Eight Hundred and forty one.

John Powers Signed, sealed, published and declared by the above named John Powers to be his Last Will and Testament in presence of us who have hereunto subscribed our names as witnesses in presence of the Testator.

Henry County Be it remembered that on this third day of May 1841, personally, came before me Eli Murphey Clerk of the Henry Probate Court, Nehemiah Powers and William Powers two of the subscribing witnesses to the foregoing Will and being duly sworn say that they saw John Powers sign seal publish and declare the foregoing to be his Last Will and Testament that they believe he was of sound mind and memory at the time he executed it, that they signed their names thereto as witnesses in the presence of the said Testator and at his request and in presence of each other.
